Man, 22, banned after ‘drink and drug driving’ near Louth

A man has been banned from driving for 19 months after he admitted driving with excess alcohol in his system, under the influence of drugs, and in possession of cannabis.

James Lumley, 22, of Caistor Lane, Tealby, admitted the offences and was said to be the driver of a Renault car which left the road and collided with a tree on the A631 at Cross Cliff Hill at Kelstern, near Louth, at about 7pm on April 10.

Prosecuting at Boston Magistrates’ Court last week, Stacey Mills said Lumley was arrested after giving a positive breath test with a reading of 51 microgrammes of alcohol in his breath, the legal limit being 35.

A search of his car revealed a small quantity of cannabis and a drugs swipe showed he had been driving with 12 microgrammes of cannabis in his bloodstream, the legal limit being two.

Mitigating, Daven Naghen said Lumley, who was of previous good character, did not use cannabis as a recreational drug but to help him sleep because he had back pain.

He was banned from driving for a total of 19 months but was offered the drink drivers rehabilitation course, which will reduce the period of the ban by 19 weeks.

He was also fined £217 and ordered to pay £117 in court costs and charges.
